Driving under the influence is a serious crime. A first offense may be relatively simple to resolve, but a second or subsequent DUI will be punished more severely than the first. A fourth charge is a felony offense.
A person charged with a first DUI in California can expect to have their driver’s license suspended for a year, three years of summary probation, and several requirements of probation.
Among other considerations, the first step in analyzing a DUI case is whether there was lawful cause for the search or seizure of a person such as an unlawful stop of a vehicle or sample of blood being taken without permission or a search warrant. Unlawfully seized evidence may be excluded from use in court through use of a motion to suppress pursuant to the Fourth Amendment Right Against Unreasonable Searches and Seizures.
Next, it is necessary to review and analyze the toxicology and any other scientific or medical reports and evaluate the science and methods which were used in order to contest their accuracy.
