Domestic Violence
It is very common to be falsely accused of domestic violence, probably more than any other kind of false accusation. It is even common to be charged with domestic violence after using self defense or even after an accident. This sometimes occurs because of anger, jealousy, or even to gain an unfair advantage in divorce and child custody proceedings.
Criminal charges which may be involved in an incident or allegation of domestic violence include:
Penal Code 243e1 PC – Domestic Battery
CA Penal Code 236 PC – False Imprisonment
CA Penal Code 273a - Child Endangerment
CA Penal Code 273d PC – Child Abuse
CA Penal Code 646.9 PC – Stalking
CA Penal Code 273d PC – Child Abuse
CA Penal Code 273.5 PC – Corporal Injury to a Spouse or Cohabitant
In addition to criminal charges, assault, battery, or other accusations of violence can subject one to civil liabilities which would be in separate proceedings in a civil court.
